Terms of Service

These terms govern your use of WaterTite Mitigation services and website. Please read them carefully.

Last updated: March 1, 2026

1. Agreement to Terms

By accessing our website, using our services, or engaging WaterTite Mitigation (“Company,” “we,” “us,” or “our”) for water damage mitigation and restoration work, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.

2. Services Provided

WaterTite Mitigation provides water damage mitigation and restoration services, including but not limited to:

  • Emergency water extraction and removal.
  • Structural drying and dehumidification.
  • Mold prevention and antimicrobial treatment.
  • Sewage and biohazard cleanup.
  • Documentation and moisture monitoring per IICRC S500 standards.
  • Insurance claim documentation and adjuster coordination.
  • Client portal access for real-time project tracking.

Our services are limited to water damage mitigation. We do not perform reconstruction, general contracting, plumbing repairs, roofing, or mold remediation. We may provide referrals to qualified contractors for these services.

3. Scope of Work

Before beginning any work, we will provide you with a written scope of work detailing the services to be performed, the estimated timeline, and the estimated cost. By authorizing work to begin, you agree to the scope as written. If additional damage is discovered during the restoration process, we will notify you, document the findings, and obtain your authorization before expanding the scope of work.

4. Authorization and Access

By engaging our services, you represent that you are the property owner, an authorized agent of the property owner, or a tenant with the authority to authorize water damage mitigation work on the property. You agree to provide reasonable access to the affected areas for the duration of the restoration, including daily access for moisture monitoring and equipment adjustment.

5. Payment Terms

Insurance claims: When you assign your insurance benefits to WaterTite through a direction-to-pay authorization, your insurance company pays us directly for covered work. You are responsible for your deductible and any amounts not covered by your insurance policy.

Non-insured work: For work not covered by insurance, payment is due upon completion of services unless alternative payment arrangements have been agreed to in writing.

Late payment: Invoices not paid within thirty (30) days of the invoice date may be subject to a late fee of 1.5% per month (18% per annum) on the outstanding balance, or the maximum rate permitted by Georgia law, whichever is less.

Collection: In the event of non-payment, you agree to pay all reasonable costs of collection, including attorney fees.

6. Insurance Assignment

When you sign a direction-to-pay authorization, you assign the insurance benefits related to the covered loss to WaterTite Mitigation. This assignment allows us to communicate directly with your insurance carrier, submit documentation, negotiate supplements, and receive payment on your behalf for covered work. You remain responsible for your deductible and any non-covered amounts.

7. Equipment on Premises

Drying equipment placed in your property remains the property of WaterTite Mitigation. You agree not to move, adjust, unplug, or tamper with any equipment without authorization from our team. Moving or turning off equipment can significantly extend the drying time and may result in additional charges. If equipment is damaged, stolen, or lost while in your possession, you may be held responsible for the replacement cost.

8. Limitations of Service

WaterTite Mitigation provides water damage mitigation services in accordance with IICRC S500 standards. We make reasonable efforts to restore affected areas to dry standard. However, we do not guarantee:

  • Prevention of all mold growth. Mold can develop from conditions beyond our control.
  • Restoration of materials to their exact pre-loss condition. Some materials may require replacement after drying.
  • Insurance claim approval or specific payment amounts from your insurance carrier.
  • Specific completion timelines. Drying times are affected by environmental conditions, material types, and damage extent.

9. Liability Limitation

To the maximum extent permitted by Georgia law, WaterTite Mitigation's total liability for any claims arising from our services shall not exceed the total amount paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or loss of use, except in cases of gross negligence or willful misconduct.

10. Indemnification

You agree to indemnify and hold harmless WaterTite Mitigation, its owners, employees, and subcontractors from any claims, damages, or expenses arising from your misrepresentation of property ownership or authorization, your failure to provide required access, or your interference with equipment or restoration work.

11. Photographs and Documentation

By engaging our services, you consent to WaterTite taking photographs and videos of the affected areas for documentation purposes, including insurance claim support, quality assurance, and training. These images will not be used for marketing or public display without your separate written consent. All project documentation is handled in accordance with our Privacy Policy.

12. Client Portal Terms

Access to the WaterTite client portal is provided as a courtesy to clients with active or recently completed projects. Portal access is personal and non-transferable.
